1. Scope of this Agreement

This End User License Agreement ("Agreement") governs your use of the TriviaPot mobile application software ("Licensed Application") provided by TriviaPot LLC ("we", "us"). By downloading, installing, or using the Licensed Application, you agree to be bound by this Agreement. If you do not agree, do not use the Licensed Application.

This Agreement covers the app software only. Your account, contests, and use of the wider service are governed by our Terms of Service, and your data by our Privacy Policy.

2. License Grant

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the Licensed Application on any Apple-branded device that you own or control, as permitted by the Apple Media Services Terms and the Usage Rules in the Apple App Store Terms of Service. This license is a license, not a sale, of the Licensed Application.

3. License Restrictions

You may not:

• copy, modify, or create derivative works of the Licensed Application;
• reverse engineer, decompile, or disassemble the Licensed Application, except to the limited extent applicable law expressly permits;
• rent, lease, lend, sell, redistribute, or sublicense the Licensed Application;
• remove, alter, or obscure any proprietary notices, or use the Licensed Application in any way that violates our Terms of Service or applicable law.

4. Ownership and Intellectual Property

The Licensed Application, including all software, content, trademarks, and other intellectual property, is and remains owned by TriviaPot LLC and its licensors. Except for the limited license granted above, this Agreement transfers no right, title, or interest in the Licensed Application to you.

5. Apple App Store Terms

Because the Licensed Application is distributed through the Apple App Store, the following terms also apply. In them, "Apple" means Apple Inc. and its subsidiaries.

• Party to this Agreement: this Agreement is between you and TriviaPot LLC only, not Apple. Apple is not responsible for the Licensed Application or its content.
• Maintenance and support: TriviaPot LLC, not Apple, is solely responsible for providing maintenance and support for the Licensed Application. Apple has no obligation to furnish any support services.
• Warranty: if the Licensed Application fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims, losses, or costs are TriviaPot LLC's responsibility.
• Product and IP claims: TriviaPot LLC, not Apple, is responsible for addressing any claims by you or a third party relating to the Licensed Application, including product-liability, legal-compliance, and intellectual-property-infringement claims.
• Legal compliance: you represent that you are not located in a country subject to a U.S. Government embargo or designated as terrorist-supporting, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Third-party beneficiary: Apple and its subsidiaries are third-party beneficiaries of this Agreement and, upon your acceptance, have the right to enforce it against you.

6. Term and Termination

This Agreement is effective until terminated. Your rights under it end automatically if you fail to comply with any of its terms. Upon termination you must stop using the Licensed Application and delete all copies. Sections that by their nature should survive termination (ownership, disclaimers, and limitations of liability) survive.

7. Disclaimer of Warranties

The Licensed Application is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by applicable law.

8. Limitation of Liability

To the maximum extent permitted by applicable law, TriviaPot LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or relating to your use of the Licensed Application.
